Terms of Service

1. Introduction
Welcome to Botsy. These Terms of Service ("Terms") are a binding legal agreement between you and Botsy, Inc. ("Botsy," "we," "us," or "our") governing your access to and use of the Botsy websites, applications, and services (collectively, the "Platform").
The Platform connects customers who wish to book robot entertainment services and rentals with operators who offer such services. Botsy is a marketplace facilitator. We do not own, control, or provide the robot services or rentals. We are not a party to the contract between you and an operator. Botsy is not an agent for any user.
Your use of the Platform is also subject to our Privacy Policy, which describes how we collect and use personal information.
2. Customer Terms
These sections apply when you browse, search, or book services or rentals on the Platform as a customer.
2.1 Searching and Booking
You can search for robot services and rentals by product type, date, duration, and other criteria. When you add a booking to your cart and complete checkout, you agree to pay all charges including the listing price, applicable fees, and taxes. A booking is created as a hold when added to cart; it becomes pending when your order is placed. The operator may accept (confirmed) or decline (cancelled) the booking.
2.2 Cancellations and Refunds
Cancellation and refund terms are set by each operator and displayed in the product listing (e.g., in "Things to know" or the cancellation policy field). If you cancel, the amount refunded depends on the operator's cancellation policy. If the operator cancels, you may be eligible for a full or partial refund. Contact us for assistance with cancellations or disputes.
2.3 Your Responsibilities
You are responsible for your own conduct and for anyone you invite to a service or rental. You must provide accurate information, comply with any age or other requirements stated in the listing, and treat operators and their property with respect. You are responsible for any damage you cause to the operator's equipment or property.
2.4 Assumption of Risk
Robot services and rentals may involve inherent risks. You acknowledge that you assume the risk of participating in or using such services. It is your responsibility to determine whether a service or rental is suitable for you and any guests. Botsy does not insure customers and does not guarantee the safety, quality, or legality of any listing or operator.
3. Operator Terms
These sections apply when you list services or rentals, manage availability, or fulfill bookings as an operator (vendor) on the Platform.
3.1 Operator Application
To become an operator, you must submit an application. We review applications at our discretion and do not guarantee approval. Information you provide in your application is used to evaluate your eligibility. We may contact you for additional information.
3.2 Listing and Availability
You are responsible for creating and maintaining accurate listings, including descriptions, pricing, availability schedules, and any rules or requirements. You must keep your calendar and product information up to date. You are responsible for understanding and complying with any laws, permits, or regulations that apply to your services or rentals.
3.3 Accepting and Declining Bookings
When a customer places an order, the booking enters a pending state. You may accept or decline pending bookings. If you accept, the booking is confirmed and you are obligated to fulfill it. If you decline, the booking is cancelled and the customer may receive a refund. You may cancel confirmed bookings only for valid reasons (e.g., emergency, force majeure); unreasonable cancellations may result in penalties.
3.4 Cancellation Policy
You may set a cancellation policy for your listings (e.g., free cancellation up to 48 hours before). Your policy must be clearly disclosed in the listing. Botsy may override your policy in exceptional circumstances (e.g., major disruptive events).
3.5 Taxes
You are responsible for determining and fulfilling your tax obligations, including income tax, sales tax, VAT, or other taxes that may apply to your earnings. We may collect and remit certain taxes on your behalf where required by law.
3.6 Independence
Your relationship with Botsy is that of an independent contractor. You are not an employee, agent, or partner of Botsy. You have discretion over how you provide your services, your pricing, and your schedule. You are responsible for your own insurance and liability.
4. General Terms
4.1 Accounts
You must provide accurate and complete information when registering. You are responsible for maintaining the security of your account and for all activity under it. You must be at least 18 years old to use the Platform.
4.2 Content
You grant Botsy a non-exclusive, worldwide, royalty-free license to use, display, and distribute content you submit (e.g., photos, descriptions, reviews) for operating and promoting the Platform. You represent that you have the right to grant this license and that your content does not violate any third-party rights or applicable laws.
4.3 Communications and Marketing
By creating an account, you agree that we may send you transactional emails (e.g., order confirmations, booking updates, password resets). We may also send you marketing emails (promotions, updates, tips) if you have opted in. You can unsubscribe from marketing emails at any time using the link in any marketing email. Opting out of marketing does not affect transactional communications.
4.4 Fees
Botsy may charge fees for use of the Platform. Fees will be disclosed before you complete a transaction. We may change fees with notice. Except as otherwise stated, fees are non-refundable.
4.5 Platform Rules
You agree not to:
- Violate any applicable law or third-party rights
- Provide false or misleading information
- Harass, discriminate, or harm others
- Circumvent the Platform to avoid fees or for other reasons
- Scrape, hack, or interfere with the Platform
- Use the Platform for any illegal or unauthorized purpose
4.6 Termination
You may close your account at any time. We may suspend or terminate your account or access to the Platform for any reason, including breach of these Terms. Upon termination, your right to use the Platform ceases. Provisions that by their nature should survive (e.g., liability limitations, indemnification) will survive.
4.7 Disclaimers
THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. BOTSY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT ENDORSE OR GUARANTEE ANY OPERATOR, LISTING, OR SERVICE. WE DO NOT INSURE USERS. VERIFICATION OR SCREENING (IF ANY) DOES NOT GUARANTEE SAFETY OR SUITABILITY.
4.8 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTSY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM OR ANY INTERACTION WITH OPERATORS OR CUSTOMERS. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BOTSY IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
4.9 Indemnification
You agree to indemnify, defend, and hold harmless Botsy and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your use of the Platform, your interaction with other users, or your violation of any law or third-party rights.
4.10 Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Platform shall be resolved in the state or federal courts located in Delaware. You agree to submit to the personal jurisdiction of such courts.
4.11 Modifications
We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated via email or a notice on the Platform. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Platform.
